Dispute Resolution
Any disputes arising out of or relating to these terms, our products, or our services shall be resolved through the following process, in order:
Step 1 - Informal Resolution (Required) Before initiating any formal dispute process, you must first contact Maatruu LLC at maatruu.llc@gmail.com to attempt to resolve the dispute informally. Both parties agree to make a good faith effort to resolve the matter within 30 days.
Step 2 - Mediation (Required) If the dispute is not resolved informally within 30 days, either party may initiate mediation. Mediation shall be conducted by a mutually agreed-upon mediator. If the parties cannot agree on a mediator within 14 days, Maatruu LLC shall select the mediator. The cost of mediation shall be shared equally between the parties. Mediation shall take place in the State of Kansas at a location determined by Maatruu LLC.
Step 3 - Binding Arbitration If mediation does not resolve the dispute, the matter shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator selected by Maatruu LLC. The arbitration shall take place in the State of Kansas at a location determined by Maatruu LLC. The arbitrator's decision shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Maatruu LLC.
Small Claims Exception Notwithstanding the above, either party may bring an individual action in small claims court in the State of Kansas if the claim falls within the court's jurisdictional limits.
Venue and Jurisdiction For any dispute not subject to arbitration, or for enforcement of any arbitration award, exclusive venue and jurisdiction shall lie in the state or federal courts located in the State of Kansas. Maatruu LLC shall have the right to select the specific venue within the State of Kansas. You irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue.
Governing Law All disputes shall be governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict of laws principles.
Limitation on Claims Any claim arising out of or relating to your use of our website or purchase of our products must be filed within one (1) year after the cause of action arises. Any claim filed after this period is permanently barred.
Assumption of Risk
By purchasing products from Maatruu LLC, you acknowledge and accept that:
- Handcrafted products may have natural variations
- Colors and appearance may differ from images shown online
- Sizing may vary between different styles and products
- You are responsible for reviewing product descriptions, size charts, and policies before purchasing
Force Majeure
Maatruu LLC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, supply chain disruptions, shipping carrier delays, acts of war or terrorism, or any other force majeure event.
Severability
If any provision of this Legal Notice is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
